The website www.cotswoldhomeandgardencompany.com URL, is a trading name of Ryder International VAT registration number 869 555 659 and references to Company, "we", "us" and "our" shall be deemed to be references to Ryder International References to buyer, "you", and "your" shall be deemed to be references to the person placing an order via this website.
TERMS AND CONDITIONS OF SALE FOR STONE FLOORING
It shall be the responsibility of the Buyer to check and ensure that all details relating to the order are correct and provide the Company with relevant information relating to the environment in which the Goods are intended to be used and for their delivery.
The Company at their discretion can provide estimates of Goods but this will be based on general guidance only and the Buyer should not rely on this estimate. It shall be the Buyers responsibility to ensure they have ordered the correct quantity of Goods and the Company shall not be responsible for any shortfall or surpluses.
Where products are supplied in a pattern format involving different sized products to complete a pattern the Company reserves the right to only supply the pattern as a whole and not individual constitute parts.
If an order which has been accepted by the Company is either cancelled or varied by the Buyer, then the Buyer shall be responsible to pay the Company any costs, losses, or expenses properly and reasonably incurred or suffered by the Company as a result of the cancellation or variation.
Any Goods purchased ex-display or special offer tiles are sold as seen and the onus is on the Buyers to satisfy themselves as to the quality at time of purchase. No refunds/exchanges will be available on these Goods.
All descriptions, images, (in both print and on the internet) advertising, and specification are for purposes of giving an approximate representations of the Goods only and their accuracy cannot be warranted by the Company.
The Company shall be under no liability in respect of natural and geological variations occurring in terms of colour, markings, texture, size, and between consignments, which are beyond the control of the Company.
Buyers who order from the "Honed & Filledâ€Ÿ travertine range must accept the following natural occurrence; cavities found on the surface, not those inside are filled with compound at the factory. After installation, those cavities that are just underneath the surface may appear due to wear and tear. These internal cavities may appear in no specified time i.e. 3 months, or 3 years which may not be controlled or prevented.
The sample is supplied within the Company's tolerance limits of size, texture and colour variation. The Company cannot guarantee to match shades of the samples presented or any previous orders supplied.
All natural tiles are to a greater or lesser extent porous and need to be impregnated with industry recognised materials. Some stones may be easily scratched and / or is subject to pitting /chipping.
Stone delivered to site must be stored securely in suitable conditions. Tiles must always be stacked and stored vertically (on edge) but not on hard surface as this can cause unnecessary edge chipping.
The Company strongly suggest that all tiles are blended before installation. The installer must have an understanding of blending requirements or special patterns as part of the skills.
The Buyer should always consider wastage on each project before ordering, for instance minor damage to some stones which may occur in transportation or during site handling, site cutting and grading.
Whilst sorting tiles to ensure suitable blending, normal practice calls for segregation of tiles with minor damages or some unusual markings. They can be used where cut tiles are required, or in less visible locations. Natural stones is particularly susceptible to colour and tonal variations from batch to batch.
Stone tiles are always packed in wet conditions at the factory and cannot properly dry out until unpacked; they will lighten in colour as they dry. It is therefore essential that all tiles are completely dry prior to installation to be able to assess any colour variation present. To check this, it may be necessary to place a tile in front of a direct heat source to see the true colour of the stone when it is totally dry.
Delivery charges shall be paid by the Buyer and will vary dependent on size, weight and distance from the Company warehouse.
Any dates quoted for delivery of the Goods are approximate only and the Company will endeavour to have the Goods delivered to the delivery address on the delivery date but the time for the delivery shall not be of the essence unless previously agreed by the Company in Writing.
Where the Goods are to be delivered in instalments, each delivery shall constitute a separate contract and failure by the Company to deliver any one or more of the instalments in accordance with these Conditions or any claim by the Buyer in respect of any one or more instalments shall not entitle the Buyer to treat the Contract as a whole as repudiated.
Delay due to circumstances outside the control of the Company shall not entitle the Buyer to cancel any order or refuse delivery.
The Goods will be off-loaded at the nearest accessible point to the delivery address at the discretion of the driver, which may be kerbside.
The Buyer shall inform the Company of any access restrictions or difficulties for a large lorry with tail-lift (and pump truck) and that the Buyer must ensure a suitable/responsible person is at the delivery address at the time of the delivery to supervise the off-load and to sign for the Goods.
The Buyer shall be responsible for the movement from the vehicle off-load position to its final destination (onwards handling).
If delivery is unsuccessful due to no one being at the delivery address at the time of delivery or due to the Buyer failing to inform of private inaccessibility or relevant restrictions, the driver will retain the Goods and the Company will await further instructions from the Buyer. Note the Buyer will be charged additional delivery charge in these instances (for every attempt to re-deliver).
Examination, Reporting Damage and Acceptance
- The Company takes care to ensure that all Goods leave in perfect condition. Goods delivered to the Buyer must be checked immediately and any damages/faults must be reported to the Company in Writing, within 48 hours of delivery.
- If there is any obvious damage to the Goods, please make a note of the damage on the delivery note,
- Check your delivery fully, take a digital photo of the damaged items and forward to us with a written statement of damages as soon as possible as this will enable the Company to claim against the carrier.
- Shortages, damaged and incorrect deliveries notified to the Company wherever possible will be remedied within a further 14 working days subject to availability and transportation.
- The Buyer shall deemed to have accepted the Goods, if they are not returned or rejected within 7 working days of delivery or the Goods have been fitted/fixed or attempted to fit/fix to a wall or floor.
Cancellation and Returns
- In the unlikely event that the Buyer is unhappy with the Goods supplied (excluding the reasons of quality i.e. faults in sizes, finishes etc), the Buyer has the statutory right to cancel this contract within 7 working days of the delivery (except for those orders which were specifically made) and that the Goods must be returned to the Company within 14 days and the purchase Price will be refunded in full on confirmation that the Goods are in the same condition including original packaging as delivered. No credit will be issued for any material returned damaged.
- No returns will be accepted after 7 working days. In exceptional circumstances, Goods may be accepted for credit within 28 days of the purchase and where such consent is given. The client shall pay for the cost of the delivery/collection of the returned goods.
- Risk of damage to or loss of the Goods shall pass to the Buyer upon delivery.
- Notwithstanding delivery and the passing of risk in the Goods, or any provision of these
- Conditions, the ownership in the Goods shall not pass to the Buyer until the Company has received full payment or by way of cleared funds in full of the Price of the Goods.
- No part of this Contract affects the Buyers statutory rights.
- The Company shall not be liable to the Buyer or be deemed to be in breach of the Contract by reasons of delay performing, or any failure to perform, any of the Companyâ€Ÿs obligation in relation to the Goods, if the delay or failure was due to Act of God, the Buyers act or any cause beyond the reasonable control of the Company.
- The Company accepts no liability for consequential loss or damage to property, which is attributed to the failure of the Goods supplied whether due to accident, abuse, and incorrect technical assessment by the Company. In any event the Companyâ€Ÿs maximum liability in all cases shall be limited to the invoice value of the Goods supplied.
- If any provision of these Conditions is held by any competent authority to be invalid or un-enforceable in whole or in part, the validity of the other provisions of these Conditions and the remainder of the provision in question shall not be affected.
- This Contract shall be governed by the laws of England and both the Company and the Buyer agree to submit to the non-exclusive jurisdiction of the English courts.
TERMS AND CONDITIONS AND WARRANTIES FOR WOOD FLOORING
All our wood flooring is supplied by the Solid Wood Flooring company and therefore all wood flooring sold is subject to their terms and conditions
The Warranties described below are given to the original purchaser only AND ARE SUBJECT TO THE PROCEDURES, LIMITATIONS, DISCLAIMERS AND EXCLUSIONS SET FORTH HEREIN. The Warranties cover only approved product applications as recommended by the solid wood flooring company. This warranty only covers residential usage of the product. Solid, bamboo and engineered floors are manufactured in accordance with accepted industry standards, which permit a defect tolerance not to exceed 5%.
The defects may be of a manufacturing or natural type. This 5% allowance is not valid under this warranty and it is the owners and installers responsibility for all products installed. This warranty applies only to material in excess of 5% that is deemed to be defective. The conditions of this warranty shall only apply when proper installation procedures are followed. This warranty shall not apply to solid hardwood and bamboo floors which are installed in a basement, directly on a concrete slab that has more than 10% moisture content, nor on substandard or OSB (pressed wood) floors, nor in a room equipped with an in-floor radiant heating system for boards over 90mm wide, or where high temperatures and varying excessive humidity occurs. All guidelines in the underfloor heating (UFH) section must be strictly adhered to for this warranty to apply.
We will not accept returns or claims of any kind if the wood flooring has been delivered before the completion of wet trades including plastering, plumbing and any trades that will increase the humidity of the building. Wood flooring should not be stored in any area where the humidity is more than 60 % and must not be subjected to direct heat if an area is damp and you are trying to dry it out. We will not accept any returns of cartons of wood flooring if the shrink wrap on the cartons has been removed.
All negotiations for fitting, terms of business and payments should be made direct to the fitting company you employ. Our recommended fitters are the best we know and if you follow their advice then you should have a trouble free installation and a lifetime of enjoyment from you wooden floor.
Installer and Purchaser Responsibility
Should you wish to return the flooring after having received a sample and confirming the order during the 7 working day cooling off period then we will refund the cost of the flooring and the transport cost, however this will not apply if you have fitted and installed the floor. It is critical that all installations are done in compliance with the procedures outlined in the solid wood flooring company's installation and maintenance instructions. Failure to install in accordance with the instructions and to properly maintain your wooden floor will void all warranties.
No warranty coverage is provided for flooring that contains obvious defects of any kind that were installed nonetheless. It is the installers and purchasers responsibility to set aside pieces with visible defects and not use them and you must make sure that the flooring meets the purchaserï¿½s expectations prior to installation. Likewise, it is the installers and purchaser's responsibility to check that the moisture content of the uninstalled flooring is within the acceptable range that the solid wood flooring company warrants of 6% to 9% prior to installation.
The installer and purchaser are also responsible for ensuring that the subfloor has an acceptable moisture content ( 4 % ) and that the relative humidity conditions at the site are suitable (35% to 55% relative humidity) prior to installation. It is the installers and purchaser's responsibility to inspect the flooring prior to installation and to install the floor in a random and harmonious mix, and with good workmanship. The solid wood flooring company's warranty does not apply to claims made on pieces of flooring installed with color/grain variation and this warranty does not cover poor workmanship by the installer. Once the flooring has been installed, the installer and purchaser have deemed the flooring acceptable and the solid wood flooring company assumes no further responsibility for defects visible at the time of installation or moisture/humidity problems.
You should only use engineered boards with underfloor heating and the surface temperature must not exceed 27 degrees. If the surface temperature exceeds 27 degrees and any of the installations conditions are not met then we cannot warranty our floors. Acclimatization: with underfloor heating even engineered boards should be acclimatised and stored in the conditions that they are to be laid for at least 7 days prior to fitting.
The boards should never be left in a damp cold place and then fitted in a warm moist room this would be a disaster waiting to happen and this could occur 6 months to a year later. The installation of the flooring must be carried out according to our recommendations in the underfloor heating technical section, the most important aspects being that the underfloor heating system must be commissioned and working at full temperature to test the controls and then turned off so it is completely cold and left for 2 days. The floor should then be installed and left for 72 hours before starting the underfloor heating system which must be gradually turned up by no more than 2 degrees a day. In addition excessive sunlight and extreme temperature and humidity variations are not covered under any of our guarantees or warranties especially where there is underfloor heating. Please do not come to us for a claim if you have not followed our conditions.
Lifetime Residential Structural Integrity Warranty:
The solid wood flooring company warrants that these hardwood, bamboo and engineered floors in their original manufactured condition, to be free from defects in material and workmanship. This includes milling, assembly, dimension and grading for as long as the original purchaser owns the floor. Engineered floors are warranted against delamination (separation between plies) when installed in normal environmental conditions of relative humidity from 35% to 55%, and provided the flooring is not soaked in water and that there is no water ingress in any form either physical or vapour either from above or below. A rich variety of natural wood characteristics such as knots, mineral highlights, pin holes, distinctive differences in color, and grain configuration provides the truest wood grain texture and detail that nature has to offer. These natural appearances are not construed as defects. Being a natural material, hardwood floors will react to humidity and temperature variations. In high humidity, wood picks up moisture and swells; in low humidity wood releases moisture and shrinks. At some periods of the year splits may temporarily appear between the boards. This phenomenon is normal and it is not covered by the warranty. The solid wood flooring company hardwood floors must be installed in environments of 35%-55% relative humidity for coverage under the warranty and to prevent possible damage, such as excessive swelling and/or shrinkage or other movement, due to extreme dryness/humidity. Installation of a humidifier or dehumidifier may be necessary. The floor is designed to perform in an environmentally controlled structure.
A 20-Year Residential Finish Warranty:
The solid wood flooring company warrants to the original purchaser, under normal residential traffic conditions and with proper maintenance that the pre-finished surface will not peel off or wear through for 20 years from the date of purchase by the original purchaser. Gloss reduction is not covered under the finish warranty since it is not considered wear through. It is important to note that a floor exposed to sunrays (ultraviolet light) or to an intensive lighting system may alter in a subtle way the colour of the floor. This is a natural reaction for wood floors which cannot be recognized as a finish default. The warranty does not cover such fading of your floor. It is recommended periodically to move area rugs in order to minimize the effects of ultraviolet light on your hardwood floors. Warranty excludes any scratches, dents, notches and any damages to the finish caused by lack of proper maintenance, negligence, inappropriate use of floors, fire, burns, excessive heat, cold, indelible liquids, water, moisture, erosion, external environmental conditions, accident, natural disaster, stones, sand, other abrasives and corrosives material, insect infestation, animals and domestic pets, theft, vandalism, sharp or blunt edge objects, excessive impacts, heavy furniture not moved correctly like ï¿½draggingï¿½ it across the wooden floor, spiked heel shoes, crib and rocking chair, casters, insufficient protection in kitchen and under furniture, wet mopping or failure to follow all the manufacturerï¿½s written maintenance instructions. Use of floor care products other than those recommended by the solid wood flooring company may damage your floor and may void the warranty.
Additional Warranty Disclaimers and Exclusions:
In addition to all the above stated warranty disclaimers and exclusions, this warranty shall not apply to all of the following:
Water damage to the flooring caused by broken or leaking pipes; Damage to the flooring caused by flooding, hurricanes, other natural disasters, and Acts of God; Damage to the flooring caused by improper handling, shipping and storage; Installation of the flooring in an environment outside of the 35% to 55% relative humidity range; Installation of the flooring on a moist, damp, wet or leaking or otherwise unsuitable subfloor ; Improper alterations and maintenance of the original manufactured product; Failure to follow all the manufacturerï¿½s written installation and maintenance instructions; and no warranties shall apply to any product or products designated and sold as clearance or non-standard items. Any product or products so designated are sold ï¿½as seenï¿½.
Exposure of the flooring to sunlight will alter the colour of the floor, exposure for prolonged periods to excessive heat from the sun through glass in summer (such as conservatories) will make it shrink and it will then expand in winter, this will happen even with engineered flooring, this is not covered under our warranty. This is a natural reaction for wood floors which is not considered a defect and not covered by the warranty.
If in the unlikely event any portion of your floor should fail with respect to the provisions of these warranties, the solid wood flooring company will replace (material only) such portion, at no cost to the original purchaser, with the same product or another product of equal value. To file a claim please contact the solid wood flooring company, attention to Claims Department. Claims must also be filed within the warranty coverage period and a receipt verifying the date of purchase and the ownership of the products will be required. The solid wood flooring company warranties are not transferable and the warranties are valid ONLY if the owner can provide an original proof of purchase. The solid wood flooring company reserves the rights to have a designated solid wood flooring company representative inspect the floors and remove samples for technical analysis. No distributor, installer, retailer, agent or employee of the solid wood flooring company has the authority to alter the obligations or limitations of any solid wood flooring company warranty. Complete the Installation:
- At completion of the installation, vacuum thoroughly and clean the floor with a proper wood flooring cleaner on a soft, cloth mop. Then wipe the surface clean to remove loose dirt or soil.
- Reinstall all base and/or quarter round moldings, skirting boards etc. Nail the moldings and or skirting boards into the wall, not the floor.
- Install any transition pieces that may be required, such as reducers, T-moldings and stair nosing.
- Keep several spare boards from the installation in the event of future repairs.
- Floor Care and Maintenance Guidelines:
- Remove loose dirt and grit from the floor on a routine basis using a soft broom or vacuum. It is important that abrasives are removed from the flooring because they can scratch the floor finish.
- Promptly wipe up liquid or food spills with a soft, clean cloth.
- The floor can be cleaned with a clean and dry soft cloth. DO NOT wet mop, damp mop or use water to clean the floor unless you are using one of the recommended maintenance kits.
- It is recommended that area rugs are placed in kitchen areas and high traffic areas. Ensure that the area rugs used have a breathable material so that moisture can escape (i.e. do not use area rugs with a vinyl or solid rubber backing).
- Equip rolling furniture with soft rubber chair casters and fit furniture legs with felt tips. Always use a dolly and protective sheets of plywood when moving heavy objects, furniture or appliances. Never roll or slide objects directly on the floor.
- Place mats at outside entrances, and clean shoes on mats before walking on floor so as to avoid tracking dirt and abrasives onto the floor.
- Do not walk on the floor with shoes with spiked or damaged heels or sport shoes with spikes or cleats.
- Keep pets nails trimmed to avoid scratching the floor and their paws clean and free of dirt.
- Use curtains, blinds, drapes or other suitable means to protect the floor from direct exposure to sunlight.

PLACING AN ORDER
By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. By placing an order via this website you are making an offer to Cotswold Home and Garden to purchase the goods detailed in your order upon the terms described in your order.
Once you have placed an order we will send you an invoice and confirmation email that your order has been received but this is not a confirmation that your offer to purchase the goods has been accepted. A contract between you and Cotswold Home and Garden Company for the sale of our products will only exist once an order has been accepted, processed and despatched to you. Your credit/debit card will be authorised when your order is placed and processed but you will not be charged for the value of the goods until the point that they are despatched to you. This does not affect your statutory rights.
Prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate. Please see our delivery times and charges.
All dates quoted for delivery are estimated delivery dates only and may be subject to change. We can accept no liability for any loss or damage (whether direct or indirect) if delivery takes place at any time other than the estimated date for delivery. All orders received and accepted before 3pm will, subject to availability and where possible, be despatched on the following day for a 5 working day delivery. Those orders received and accepted after 4pm will be deemed as received the following day and will be despatched the day after.
OFFER TERMS AND CONDITIONS
Discount codes and promotions cannot be used in conjunction with any other offer. Our products are already discounted so your promotion or discount code will not be valid when purchasing sale items. The offer is subject to availability on full priced items only. You cannot use these vouchers when available to discount delivery as we only pass on the cost that we actually incur.
Any email offer is only valid when you click through to the web site and make a purchase. Only one offer per customer is allowed. These offers only last whilst current stocks last and once the stock is gone the offer is deemed to have expired.
FREE DELIVERY (no such thing)
We do not offer free delivery as the cost has to come from somewhere and it would always be an inflated price on the product in the first place, we offer a highly competitive service and products and try to be as transparent as possible with both product pricing and delivery and we only pass on what we are charged for delivery.
CONFORMITY OF GOODS
We take every care to ensure that the description and specification of our products are correct at the time of going to press and entry on the website. However, specifications and descriptions of products on this website are not intended to be binding and are intended only to give a general description of the products. Furthermore, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used to view the products. Also natural products like wood flooring and stone will vary and samples should be requested so that you know what you will be getting.
We endeavour to display through this website all items in our current range. We aim to hold stock of these items and have them available for immediate delivery. However, occasionally an item will be out of stock and if this is the case this will be highlighted and you will not be able to put it in your shopping basket so please call us for an update on availability. Should the system allow you to proceed with a purchase where the item has gone out of stock overnight we will call you to inform you of the availability the following day and you have the right to cancel your order or agree to wait until the item is back in stock.
YOUR RIGHT TO CANCEL

If you are not entirely delighted with the products that you have chosen you may return them to us within 30 days of receipt. We will be happy to offer you an exchange or, if you wish, a refund provided that the products are returned complete, in perfect condition, unused, and in their original carton or packing. We cannot accept an item returned as faulty if the appropriate product care instructions have not been followed and the damage caused to the product is clearly due to wear and tear or misuse. All prices quoted on this website are accurate at the time of publication, are quoted in pounds sterling and where appropriate are exclusive of UK sales tax (VAT) at the current rate. If your order is being despatched to a destination outside the European Union (EU) then your sales tax will be zero. If your order is being sent to a member state of the EU then the selling price will include VAT. You will be responsible for the payment of any customs or import duties levied once the package reaches your destination country.
SECURITY OF PAYMENT
If your credit/debit card is used fraudulently as a direct result of being used to buy from our site, we will assume liability for the first £50 of your loss. Your credit card company is under obligation to take responsibility for the rest. We will use reasonable endeavours to work with your credit card company to minimise the hassle for you.

Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.
DISCLAIMER & LIMITATIONS OF LIABILITY
Cotswold Home and Garden Company does not seek to exclude or limit liability for death or personal injury arising from its negligence or that of its members, agents, directors or employees or for any fraudulent misrepresentation. How we store and use your information:
By agreeing with our T&Cs you allow us to store your information for the purpose of contacting you regarding your enquiry and potentially your order. We will also use your contact information to occasionally send you information on new products, deals or general follow up procedures. If you have contacted us through our website, your information such as name, address and contact details will be stored on our secure web server. We will also add these details including information on the products you've chosen to our desktop-based client database and if a payment order is processed our accounts system. We also keep a record of any payments made including where applicable card payment data. We will not sell on or make freely available your information with the exception of sharing necessary information (such as contact information and delivery notes) with delivery companies. We generally use Brooks Transport Services, UPS, Royal Mail and DHL services.
